Well, I thought "5V tolerant" means that as long as you don't violate the maximum output current you should be able to do this... What does the datasheet say?

A sidenote, Philips has somewhere an appnote how to interface 3V and 5V correctly (using a FET) - the appnote is targeted for I2C but is perfectly valid for any other 3V/5V interface.
