I would disagree that Microsoft always runs at 12. At best they run at 11 since there is evidence that they don't follow rule #5: "Do you fix bugs before writing new code?"

But rule #5 can be substituted with "Are you a monopolist engaged in monopolistic business practices?" If so, you could probably get by with a 2 or 3 and still own the market. :)
