Of course that's only for things that are covered by the DMCA, but I think the white paper in Joe Kimbriel's link shows that the entire subject is a lot more complicated than you are making it out to be, and "I didn't look at the source code" is not going to be a useful defense if you ever find yourself in court. Nobody should ever rely on armchair experts for legal advice, and this forum should not be involved in dispensing opinions about the law. I'm pretty sure that could get Craig in a lot of trouble too.
