I agree that they should drop a note about this difference into Migrating datasheet. As for now they said only "Users of third-party programmers should download the AT89S8253 driver for their particular programmer."
Anyway when somebody have read such notification then he should think that something has been changed with it, do you?

From other side, datasheet of AT89S8253 shows these differences cleanly. First of all, Atmel specially indicates that they use SPI Mode 1 for serial downloading.
And Table 28-1 "Serial Programming Characteristics" shows parameter "MOSI Setup to SCK Low" while AT89S8252 uses opposite one "MOSI Setup to SCK High".

Indeed, most times Atmel forget important things to be indicated but careful reading of datasheets may help somehow.
