why it not 56000???

You cannot achieve 56k between two modems!
It just doesn't work that way! :-(

The 56k scheme can only ever work on the download side of a link to a suitably-equipped ISP Server - and it relies upon your telephone line being terminated at a digital exchange.
Even then you will never reach the full 56k - it's just a theoretical maximum limit. The speed you actually achieve in practice will depend on your distance from the exchange, line quality, quality of the phone wiring inside your house, the performance of your modem, and the phase of the moon...

The upload side of the link can never exceed 34k or so - again dependant upon favourable conditions.
