It is not possible to get 9600 bps with a 12MHz xtal without going out of +/- 3% error. My reference is the Dallas Semiconductor's Soft uC DataBook, Auto-Baud Rate Detection paragraph, which has a useful table with 30 xtal frequencies and the baud rates supported from 300 to 19200 bps.
