To be fair to Microchip I think you have to go look at ALL of their various I2C Serial EEPROM data sheets
.. I looked at 8 others and all 8 decoded the address.

It really is up to the design engineer to specify which manufacturers parts are acceptable for use in a particular design. If second sources are desired then the list of manufacturer sources for each part on the BOM should be listed on an approved manufacturer list
in some instances where deleivery problems are forseen we do list alternate sources, in this instance it was the CM calling: we have it all but part xxx is not available, and you need the boards next week.
