Why are you sure, that it's really the same?? Did you hack the code of your competitor, too?
What seems to be evident, need not to be evident in reality. He could have "copied" your code just from the display appearance and output signals, for instance, so that you might think that it's identical.
Also, the only chance against competitors is to be better and faster! Improve your code and make changes all the time, so that your competitor is always a step behind.
