I agree with Steve's statement about "...skilled in the art". But there is a huge problem in that in the technical field of the embedded arts it is often not possible to find defenders, judges and juries that can begin to come close to understanding the ins and outs of the technology. There is also the problem that the legal beagles are also very "skilled in their art"!!
