I few years back I contacted an attorney about a similar matter. He said something very similar. You have a right to make a living, and no former employer can prevent you. They can sue you, but they will lose, UNLESS they can prove a malicious intent. If you copy their products and they can show that you willfully tried to take away their customers (and the time limit of your non-compete agreement has not expired) then you may be in hot water.
