To me this sounds like an objection to the use of fail-safe biasing in general, rather than an issue with the way I have proposed to only drive the line low.
All fail safe is good and 0.25V is plenty, the differential nature of the bus makes it more than enough. Just look at LVDS.

The problem with your proposal is that you will need to "violate" the differential nature of the bus which opens a totally different can of worms.
