May be. But I have seen commercial equipment with EMC certification uses similar kind of ckt. I am not going into whether it is right or wrong.

With your stringent requirements I would use an appropriate ckt even it cost me more. BTW, is it really difficult to get the 3.3V ICs in India? What is the quantity you are looking at. Can't you justify the extra cost?
