Are you totally sure about that they copied your software? For such device with 2kb program memory it seems that its task is not so hard to be programmed with another engineer.
"There are many ways to do the same". If other device works like your one nevertheless it does not mean that they are identical inside at program level. From other side, there are good-known ways about how-to-do something with hardware as well -- so it may also looks like the same. Simple example: many people use 330Ohm resistor for LED connected from 5V. But LEDs may be different, sure.
