To do that it must be proven that no one in the US can or will take the job. Typically you write a set of requirements that only the one you want can fulfill. I have seen several such. My first job in the US was so many moons ago that I can not recall the exact designation of my visa, it was a H-something visa (H-3?). When I went to the tax service with a 1040 declaration filled out the person said "as a holder of that type visa you can not deduct this", "as a holder of that type visa you can not deduct that" again and again. After I had mentally decided to declare bankruptcy the person said "as a holder of that type visa you can deduct your living expenses". My sigh of relief could be heard across the Atlantic. Erik |
