To do that it must be proven that no one in the US can or will take the job. That's true in theory. In reality, there are way, way too many people in the US on H-1B visas doing work that many other unemployed Americans could certainly do. The whole concept of "proving" that no-one in the US can or will take a job is essentially asking the company to prove a negative. All they really need to do is post a job offering with incredibly insane requirements, show that no-one replied to it (because no-one is an expert 8051 programmer, VB .NET developer, and with a PhD in physics with at least 15 years experience with underwater acoustics and who also knows how to play the fiddle and trombone at the same time) and then hire an H-1B to make modifications to their in-house accounting program.
