Andy is actually correct. A trademark is a registered protection like a patent, not a copyright. It is designated by a circumscribed superscript R, not a C. I consider it akin to a copyright, because it is a graphic representation or a phrase (a slogan) that is protected instead of a devise or an idea, Nonetheless, legally it is a form of patent, and is issued by the PTO (Patent and Trademark Office). I guess it is most akin to a design patent as opposed to a utility patent. Boy I'm glad I didn't become a lawyer. |
