There is no considerable risk of set the ISP entry on UART event, if you have full control over what can occur on the UART.
For example, if there is a HDLC-like framing employed and the ISP-entry is bound to properly framed checksummed etc. packet of a particular content, there is no risk whatsoever. But this does not apply generally; that's why the manufacturers came up with more straighforward solutions (pin pulldown). The "held pin" can be of course tied to handshake signals for "touchless" operation (as it is in the 8052.com.SBC), but again, one has to be sure the "counterpart" on the communication line will never use them.
